Please read these Terms and Conditions carefully. They govern your use of this website (lutonmuslimburial.com) and set out the basis on which the Luton Muslim Burial Association ("LMBA", "the Association", "we", "us") operates. By using this website, applying for membership, or making a contribution, you confirm that you have read, understood, and accepted these Terms.
1. About LMBA
1.1. LMBA is an unincorporated community association based in Luton, governed by its Constitution. The Association exists to enable Muslims in our community to support one another — through mutual cooperation (ta'awun, Qur'an 5:2) — in meeting funeral and burial needs.
1.2. These Terms should be read together with the LMBA Constitution, which is the Association's governing document. In the event of any inconsistency between these Terms and the Constitution, the Constitution prevails.
1.3. LMBA is not a company, charity [confirm — amend if registered], insurer, or financial services provider. It is a community mutual support scheme operating on a voluntary, non-commercial basis.
2. Nature of contributions
2.1. All contributions made to LMBA are given as sadaqah — voluntary charitable giving for the sake of Allah — into a pooled community fund.
2.2. Contributions are not premiums, fees for service, savings, or investments. Once given, a contribution belongs to the community fund and is not refundable in any circumstances, including on resignation, removal, or death of a member.
2.3. No entitlement: making contributions does not create any personal, contractual, or legal entitlement — for the contributor, their family, or their estate — to any payment, benefit, or service from LMBA. This principle is deliberate and central to the Association's Islamic and legal framework.
3. Support provided by LMBA
3.1. All support provided by LMBA — financial or practical — is discretionary. Decisions on whether, when, and how support is provided are made by the Association's officers/committee in accordance with the Constitution.
3.2. Receiving support from LMBA is honourable participation in mutual cooperation, not charity received as a debtor or dependant. Every recipient is a member of a community that gives and receives together.
3.3. LMBA does not guarantee that support will be available in any particular case. Support depends on, among other things, the funds available and the circumstances at the time. No decision in one case creates a precedent or expectation for any other case.
3.4. LMBA is not a funeral director and does not itself provide funeral, burial, or repatriation services. Where LMBA assists with arrangements, the contract for those services is between the family and the relevant service provider.
4. Not insurance
4.1. LMBA is not an insurance scheme and does not provide contracts of insurance. It is not authorised or regulated by the Financial Conduct Authority or the Prudential Regulation Authority.
4.2. Nothing on this website constitutes financial advice or a financial promotion. If you require insured funeral cover, you should seek an authorised provider and, where appropriate, independent financial advice.
5. Membership
5.1. Membership is open as set out in the Constitution. Applications are considered and may be accepted or declined at the Association's discretion in accordance with the Constitution.
5.2. Members must provide accurate and complete information when applying and keep their details (including dependants' details, where applicable) up to date. [Confirm against Membership Policy: dependant rules, age limits, renewal periods, grace periods.]
5.3. Membership may lapse or be terminated in the circumstances set out in the Constitution [and Membership Policy — e.g. non-renewal within the stated period]. Lapse or termination does not entitle any person to a refund of contributions.
5.4. Members agree to be bound by the Constitution and any policies adopted by the Association from time to time.
5.5. Joining contribution: on joining, a one-off contribution to the community fund is payable, scaled by age at joining as set out below. Like all contributions to LMBA, the joining contribution is sadaqah into the pooled fund (see section 2): it is non-refundable and confers no personal entitlement to any payment or benefit.

5.6. Applications from those aged over 70 are considered individually by the Committee, which may accept the application on such terms as it considers appropriate in accordance with the Constitution.
5.7. The Association may revise the joining contribution scale from time to time. The scale in force at the date of application applies. [Confirm against the Membership Policy whether revisions require a general meeting or Committee decision.]
6. Use of this website
6.1. The content of this website is provided for general information only. It is not legal, financial, or religious advice, and it does not form part of any contract between you and LMBA.
6.2. We take reasonable care to keep the website accurate and up to date, but we do not warrant that it is complete, accurate, or error-free. Where website content differs from the Constitution or the Association's formal decisions, the latter prevail.
6.3. You must not use this website unlawfully, attempt to gain unauthorised access to it, introduce malicious code, or use it in a way that could damage or impair it.
6.4. Unless otherwise stated, the content of this website (text, logos, and materials) belongs to LMBA or its licensors. You may view and print pages for personal, non-commercial use; any other reproduction requires our prior written consent. Qur'anic text and translations are reproduced with respect and for reference only.
6.5. This website may contain links to third-party websites. These are provided for convenience; we are not responsible for their content or practices.
7. Donations and payments made through the website
7.1. Where the website enables online contributions or donations, payments are processed by third-party payment providers [name provider(s) if applicable], whose own terms apply to the processing of your payment.
7.2. Because all contributions are sadaqah into a pooled fund (see section 2), they are non-refundable. If you believe a payment was made in error (for example, a duplicated transaction), please contact us promptly and we will consider the matter in good faith.
8. Privacy and data protection

9. Liability
9.1. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
9.2. Subject to 9.1, LMBA, its officers, committee members, and volunteers — who act in good faith and without remuneration — shall not be liable for any loss or damage arising from: (a) use of, or inability to use, this website; (b) reliance on information published on it; (c) any discretionary decision made in accordance with the Constitution, including a decision not to provide support; or (d) the acts or omissions of third-party service providers.
9.3. As an unincorporated association, LMBA's liabilities are limited to the assets of the Association. [Confirm this reflects the Constitution's liability/indemnity clauses.]
10. Complaints and disputes
10.1. If you have a concern or complaint, please raise it with the committee at [contact email]. We will deal with it fairly, respectfully, and in accordance with the Constitution [and Complaints Policy, if one exists in the Drive folder].
10.2. Members agree to seek to resolve disputes internally through the processes set out in the Constitution before pursuing any other course.
11. Changes to these Terms
11.1. We may update these Terms from time to time. The current version will always be published on this page with the date of the last update. Continued use of the website or continued membership after changes take effect constitutes acceptance of the updated Terms.
12. General
12.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
12.2. These Terms, and any dispute arising from them or from use of this website, are governed by the law of England and Wales, and subject to the exclusive jurisdiction of the courts of England and Wales.
